In a stunning twist to the landmark #MeToo case, the New York state Court of Appeals has overturned Harvey Weinstein’s 2020 rape conviction.
The highest court in New York state’s judicial system ruled on Thursday that the judge in the New York County trial prejudiced Weinstein with improper rulings, including allowing women to testify about allegations that were not part of the case.
The decision orders a new trial take place.
“Under our system of justice, the accused has a right to be held to account only for the crime charged and, thus, allegations of prior bad acts may not be admitted against them for the sole purpose of establishing their propensity for criminality. Nor may the prosecution use ‘prior convictions or proof of the prior commission of specific, criminal, vicious or immoral acts’ other than to impeach the accused’s credibility,” wrote Judge Jenny Rivera in her ruling.

Harvey Weinstein is currently serving a twenty-three-year sentence in prison for r-pe and s-xual assault. Of course, this might not have been possible without the many prominent actresses who built up the courage to talk about the heinous acts of the disgraced producer, Angelina Jolie included.
Harvey Weinstein on The Graham Norton Show
After Harvey Weinstein tried to make unwanted and inappropriate advances against Angelina Jolie when she was just 21, the actress swore that she would never work with him ever again. She stayed true to the promise she made herself, but when her then-partner Brad Pitt wouldn’t do the same, she got absolutely furious, rightly so.

Painful pasts and the path forward were central to the 2022 Wif Honors last Thursday. Held at a ballroom bathed in magenta at the Beverly Hilton in Los Angeles, the annual event honors the accomplishments of women in the entertainment industry. This year, honorees included "Abbott Elementary" creator Quinta Brunson, "The Woman King" director Gina Prince-Bythewood, and "Don't Worry Darling" director Olivia Wilde.
The ceremony began how all ceremonies should: with Jane Fonda. The veteran actor, who last month disclosed her cancer diagnosis, was met with a standing ovation. Fonda was there to present the second-ever Humanitarian Award, named in her honor, to Michaela Coel, whom she described as a "boundary-pushing" artist who "makes us think about hard stuff in new ways." Fonda personally picked Coel and was an early champion of her seminal show "I May Destroy You."

(Press Association) Johnny Depp was cast into the “rogues’ gallery of abusers” highlighted by the #MeToo and Time’s Up movements after the publication of an article which labelled him a “wife beater,” his lawyers have said.
He was “cited in the same breath as disgraced film mogul Harvey Weinstein”, who had by then “become notorious” for carrying out “heinous assaults on women”, the Pirates Of The Caribbean star’s legal team argued.
Depp is suing News Group Newspapers and its executive editor Dan Wootton over the publication of an article on April 27 2018 with the headline: “Gone Potty: How can Jk Rowling be ‘genuinely happy’ casting wife beater Johnny Depp in the new Fantastic Beasts film?”

The Harvey Weinstein survivors who experienced sexual misconduct and harassment by the now-convicted rapist have been awarded a $18.875 million settlement, as part of a class-action lawsuit, aided by the New York Attorney General.
The payments, which still await approval by the bankruptcy and district courts, will resolve two separate lawsuits — one against Weinstein, Bob Weinstein and The Weinstein Company, which was filed in Feb. 2018 by the office of the Attorney General, and a separate Nov. 2017 class action lawsuit brought on behalf of the group of women who were sexually harassed and assaulted by the former movie mogul.
The settlement comes as Weinstein is serving his 23-year sentence in a New York prison, three months after he was sentenced and found guilty by a jury for the sexual assault of Miriam Haley, a former “Project Runway” production assistant, and rape in the third degree of former actress, Jessica Mann.

On Wednesday morning, sexual assault survivors all over the world sighed a breath of relief after a Manhattan judge declared that former Hollywood producer Harvey Weinstein — convicted of rape and a forcible sexual act — would be sentenced to 23 years in prison.
Inside the Manhattan courtroom, the group of six women who accused Weinstein of assault and testified during the months-long trial — Miriam Haley, Jessica Mann, Annabella Sciorra, Dawn Dunning, Tarale Wulff, and Lauren Young — embraced one another in tears as they heard that Weinstein would be behind bars for close to the maximum possible sentence. And on the opposite coast, mornings were punctuated by the ping-ping-ping of notifications from survivor group texts containing all-caps messages expressing joy and victory.

Members of the Silence Breakers – a group of women who have spoken out about sexual harassment and abuse that includes several Harvey Weinstein accusers – reacted with shock and elation after the former movie mogul was sentenced to 23 years in prison in a Manhattan courtroom on Wednesday morning.
“This is a historic moment and it’s precedent-setting,” actress and Weinstein accuser Caitlin Dulany told Variety at the “And We Still Rise: Survivors Becoming Empowered” Silence Breakers conference held at the California Endowment in Los Angeles just after the sentence was announced. “23 years seems like justice. I was assaulted by him 22 years ago and I have lived with that ever since.”
Speaking outside court in New York, Weinstein’s lawyer Donna Rotunno said that the defense team is likely to file an appeal in July — a move Dulany told Variety she had expected, but added that the complicated and lengthy process would contribute to Weinstein’s punishment.

Before being found guilty by a jury and handcuffed on his way to jail, Harvey Weinstein was accused of sexual misconduct, harassment, assault or rape by at least 100 women.
On Monday morning, the possibility of Weinstein being imprisoned seemed impossible, to some. How could one of Hollywood’s most powerful men end up behind bars? By Monday afternoon, that question became a reality.
Weinstein was convicted on a charge of criminal sex act and a charge of rape in the third-degree. He faces a maximum sentence of 29 years. The former movie mogul faced five sex crimes charges in his rape trial, which marked the first criminal trial of the #MeToo movement.

A group of Harvey Weinstein’s alleged victims has issued a statement condemning remarks made by his attorney Friday night on ABC’s Nightline.
Weinstein appeared in a Manhattan court Friday for a bail hearing. Prosecutors sought to have his bail increased to $5 million from its current $1 million, arguing he violated his terms by allegedly tampering with an ankle monitor. Weinstein has pleaded not guilty to allegations of rape and sexual assault. He’s scheduled for a follow-up hearing on Wednesday.
The ongoing legal battle appears to be taking a toll on Weinstein’s health. He looked haggard upon exiting the court house and had to be supported by two aides to make it into a waiting vehicle. The latest incident took place on Aug. 16 at a town hall meeting featuring Austin, Carteris and Modine, organized by the UnionWorking group. During the Q&a portion, Modine responded with a joke when asked why he’s the best choice by saying, “Because I’m the only man running…?”
Modine then explained that he was the only man who had been invited to participate in the town hall. Two other candidates – Abraham Justice and Queen Alljahye Searles – were not invited by the organizers.

After decades of being joined at the big-screen hip, Harvey Weinstein and his brother and longtime business partner Bob Weinstein split in late 2017 as accusations of sexual assault and harassment piled up against Harvey Weinstein.
However, the brothers were still linked in the courts. But that state of affairs for the Weinsteins, as well as several executives at their now-shuttered company and Disney, changed today.
In a ruing (read it here) on Harvey Weinstein’s unsuccessful attempt to have a nearly year and a half sex-trafficking class action suit dismissed, a federal judge in New York cut Bob Weinstein loose today. The TWC board, ex-The Weinstein Company COO David Glasser and former Hr VP Frank Gil, Disney and several others were also released permanently from the sprawling case.
After the sexual misconduct scandal broke, TWC terminated Harvey Weinstein on October 8, 2017, and, still owning 23% of the company, he formally resigned...

When TimesUp released a star-studded sizzle reel commemorating its first year, one of the most striking things about it was who wasn‘t included: any of the women who accused Harvey Weinstein of sexual misconduct.
The women who spoke up against Weinstein helped the #MeToo movement catch fire, which led to Hollywood’s creation of the reform-focused TimesUp. The group’s Jan. 1 video featured big names including America Ferrera, Kerry Washington, Oprah Winfrey, Reese Witherspoon, Tracee Ellis Ross, Natalie Portman, Shonda Rhimes, Cate Blanchett and Meryl Streep.
The exclusion of Weinstein accusers exposed growing tensions between TimesUp and #MeToo activists, who say they’ve felt ignored by TimesUp leadership for quite some time.

Harvey Weinstein, through his lawyer Benjamin Brafman, filed paperwork in New York Supreme Court on Monday asking that it dismiss the five remaining counts in his sexual assault case.
Weinstein argues that the entire prosecution has been contaminated by police misconduct.
The request comes just a few weeks after Manhattan District Attorney Cyrus Vance Jr. dismissed the accusations of Lucia Evans, who had accused Weinstein of forcing her to perform oral sex on him back in 2004. That was one of the six criminal charges Weinstein faced.

In the court documents filed on Monday, Brafman said the entire superseding indictment should be dismissed “because it was based on a defective Grand Jury proceeding, that was irreparably tainted by police misconduct, Lucia Evans’ false testimony and the District Attorney’s failure to provide the Grand Jury with exculpatory evidence of the long-term,...

After the much-accused Harvey Weinstein scored a win earlier this month when the Manhattan District Attorney dropped one of the charges against him in a criminal case that could find him behind bars for life, things potentially went to a very bad place for the once-powerful producer today.
An amended class-action complaint filed in federal court Wednesday alleges Weinstein tried to rape a 16-year old virgin model in 2002 and continued harassing her for many years afterward in both New York and Los Angeles.
Weinstein “lured” the Poland-born teen “to his apartment and sexually assaulted her, and he continued to emotionally abuse and sexually harass her for nearly a decade thereafter,” the jury trial-seeking and disturbingly detailed filing states among the consolidated claims of 10 women in total (read it here).
“As a result, Jane Doe has experienced severe emotional and physical distress,” the 264-page document against Weinstein, The Weinstein Company, the Walt Disney Company,...

In what’s sure to be one of many films that probe the depths of the Harvey Weinstein sexual assault scandal, Barry Avrich’s new documentary “The Reckoning: Hollywood’s Worst Kept Secret” gets the stories of some of his accusers and the journalists who followed what led to the #MeToo movement.
Among those featured in this first trailer for the film are #MeToo-era accusers Lauren Sivan, Katherine Kendall, Melissa Sagemiller, Starr Rinaldi, Rebecca Corry and journalists Kim Masters and Margaret Wente. They share their personal stories about dealing with Weinstein and how he impacted their respective careers.
“It was allowed to go on because he had so much power,” Sivan says in the film. “If he was some schmuck in the mail room, he’d be in jail.”
